ITO Tours UK Ltd. / ITO Tours Sports & Events Terms and Conditions Agreement
This Terms and Conditions Agreement ("Agreement") sets forth the legally binding terms for your use of the services offered by ITO Tours UK Ltd. / ITO Tours Sports & Events ("the Company"). By booking with the Company, you agree to be bound by this Agreement, which encompasses the entire process from pre-booking through to post-travel, as well as any dealings with travel agents acting on our behalf.
Scope of Applicability
- This Agreement applies to all dealings with the Company, including but not limited to the organization, offering, or sale of travel packages by travel agents under their own name or on behalf of a travel organizer not established in the Netherlands. It also covers all other forms of service provision by the travel organizer and travel agent.
- In cases where it is unclear which terms and conditions apply, this Agreement will prevail.
Online Product Offerings
- Due to rapid changes in our online offerings, we recommend you take a screenshot of the travel package when booking to avoid any future misunderstandings.
Supplementary Clauses
- Supplementary clauses to this Agreement may be agreed upon to enhance the traveller's position but cannot diminish the rights afforded by law and this Agreement. In case of conflict, the more favourable provision to the traveller will apply.
Definitions:
- "Travel Organizer": The entity offering prearranged travel packages.
- "Traveller": The individual or entity partaking in or for whom the travel package is arranged.
- "Travel Contract": The contract for providing a prearranged travel package, including accommodation and at least two other significant services.
Pre-Booking Information:
- The Company will provide necessary information regarding travel documentation and insurance.
- Travellers are responsible for obtaining any additional information and verifying the accuracy of the information provided.
Booking and Payment:
- A deposit is required upon confirmation of booking, with the total sum payable within the dates specified in the contract
- The Company is not responsible for promises made by its staff or third parties unless confirmed in writing.
Changes and Cancellations:
- Changes to bookings may incur fees and must be requested in writing.
- Cancellations must also be communicated in writing, with charges applicable depending on the timing of the cancellation.
Post-Travel:
- Complaints must be submitted in writing within two weeks after the intended travel date.
- The Company will respond to complaints within one month of receipt.
Cancellation Policy:
- Cancellations are subject to charges based on the proximity to the departure date, ranging from the loss of deposit to 100% of the total cost.
Amendment Charges:
- Amendments made after final balances have been paid may incur a charge, with late payment fees applicable for overdue balances.
Financial Protection and Security Clause
Trust Account Handling
- All bookings made with ITO Tours UK Ltd. / ITO Sports & Events ("the Company") are processed exclusively through a dedicated Trust Account ("Trust Account"). This specialized account is designed to ensure our client's highest level of financial security. All payments received from clients for travel bookings, including but not limited to deposits and total payments for trips, are deposited into this Trust Account.
Protection through PTS Trust Account
- The Company utilizes the PTS (Protected Trust Services) Trust Account system to safeguard all client funds. This system ensures that all money clients pay for their travel arrangements is fully protected against the Company's financial failure. The PTS Trust Account assures clients that their funds are secure and will be utilized solely for their travel arrangements.
Supplier Failure Insurance (SFI)
- In addition to the protection afforded by the Trust Account, the Company has a comprehensive Supplier Failure Insurance (SFI) policy in place. This policy provides coverage against the financial failure of any suppliers involved in providing travel services, including but not limited to airlines, hotels, and other service providers. The SFI coverage guarantees that in the event of a supplier's financial insolvency, the clients' travel plans are protected, and alternative arrangements or refunds will be facilitated as necessary.
Coverage Scope
- The financial protections outlined herein cover all aspects of the travel package booked through the Company. This includes air tickets, hotel accommodations, and services contracted with external suppliers. Clients can confidently book their travel arrangements, knowing that their investment is secured against unforeseen financial failures.
Client Assurance
- By booking with the Company, clients are assured of the utmost protection for their travel funds. The Company's use of a Trust Account, alongside the SFI policy, reflects our commitment to client security and financial integrity. These measures are in place to provide peace of mind to our clients, ensuring a safe and secure booking environment.
This Financial Protection and Security Clause forms an integral part of the Terms and Conditions Agreement with ITO Tours UK Ltd., underscoring our commitment to the protection and security of client funds.
